    I believe that the rules of this contest may violate certain Federal laws, first by treating those who have been members before a certain date differently than those who registered later, and second by requiring those who registered later to engage in a certain level of activity that would violate the standards of consideration. Please revise the rules to treat everyone equally. Anyone who is a lawyer in the area of “sweepstakes law” feel free to correct me.

  • Hi weatherman. No need to justify your concerns. :-) I sought legal advice before the giveaway went live and was given the green light, so I didn’t think there would be any problem. I don’t know if I got the nod because of a precedent, DFJ’s involvement, or what, but I didn’t have reason to push the matter.

    It never occurred to me that requiring new members to write five posts to be eligible could be characterized as consideration. I suppose five posts could be seen as requiring substantial effort/time, but since members have three weeks to do it, I thought it was okay.

    It’s not just the 5 posts – as I understand the rules, members who were registered before a certain date can enter 3 times where newer members can only enter twice; an insurmountable deficit. And second, to even get the second entry in the contest, new members have to post 50 times, which is also insurmountable if one doesn’t want to be a total ass and spam the forums. And it’s a lot of work (and a lot of ad watching) that I think amounts to consideration.

    I’ll leave it in your hands and that of your legal council, but I think it’s highly suspect legally and definitely alienating to new members.

  • Point taken. I was actually going to allow just one entry per person at first, but thought an extra chance to win would be more fun.

    The third “existing members only” entry wasn’t intended to alienate new members, though I understand how it could be interpreted that way. It was added as a bonus entry to “thank/reward” existing members for being a part of the forum when there was no prize incentive. It was also a way to demonstrate one of the little benefits/perks of being a member.

    50 posts is a lot to someone who just entered today/recently, I agree, but the giveaway period was really three weeks long. This comes out to just about 2 posts per day, which I didn’t think was unreasonable. This 50-post entry is completely optional as well; everyone can still submit one entry with what I consider to be little effort.

    BTW, it’ll be quite humorous if your name is drawn as the winner! :-)

    The entry rules are perfectly fair.

    A 50-post count in 3 weeks is easy if you are passionate about gadgets and there is not a whole lot of spam on the forum. Lots of great input from individuals and your entry #1 post counts towards your overall 50.

    Also, there is nothing wrong with existing members who have been part of the Pocketables forum for awhile to have a little “bonus” of 1 extra entry into the contest. It slightly boosts the odds and helps encourage future activity from new members. We too, the existing forum members, must make 50 posts within the same time frame so we do not get any special treatment.

    Just thought I would throw my 2 cents out there.
